Right of Withdrawal

Consumers have a right of withdrawal as set out below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB).

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you ordered multiple goods in one order and they are delivered separately, the withdrawal period is fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Savin Kumar Kapoor, Indian Culture, Altländer Straße 32, 21614 Buxtehude, Germany, phone: +49 176 404 710 79, email: info@indian-culture.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
You can also exercise your right of withdrawal online at www.indian-culture.de/en/widerruf (link “Withdraw from contract” in the footer of every page of our shop). If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without undue delay, containing the content of your withdrawal statement and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us (Savin Kumar Kapoor, Indian Culture, Altländer Straße 32, 21614 Buxtehude, Germany) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion and early expiry of the right of withdrawal
There is no right of withdrawal for contracts for the supply of goods which are liable to deteriorate rapidly or whose expiry date would be quickly exceeded (§ 312g(2) no. 2 BGB).
The right of withdrawal expires early for contracts
- for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery (§ 312g(2) no. 3 BGB);
- for the supply of goods which, after delivery, have been inseparably mixed with other items according to their nature (§ 312g(2) no. 4 BGB).
For our range this means: once you have opened the seal of food or cosmetic products in sealed packaging after delivery (for example sealed bags, tins or jars with a seal, bottles with a tamper-evident cap), you can no longer withdraw from the contract for these goods. Unopened, still sealed goods and goods without such a seal can be withdrawn within the period. Goods which are liable to deteriorate rapidly, for example fresh or chilled food, cannot be withdrawn either.
Notes on returns
Please return the goods with sufficient postage, well packed and, where possible, in their original packaging, and enclose a copy of the order confirmation or the order number. These requests are not a condition for the effective exercise of the right of withdrawal.
Your statutory rights for goods delivered damaged, defective or incorrect are not affected by the right of withdrawal; they are set out in § 6 of our Terms and Conditions.
